Legal context

Lingerie retail is general retail and isn't subject to the adult-establishment zoning rules that apply to sex shops. Operators need only standard New York City retail business licenses and (where applicable) county-level commercial occupancy permits.

Two regulatory dimensions do matter. First, the city's Bridal District operates under the same general-retail rules as the rest of Manhattan, but bridal salons carrying alterations or custom-fitting services may need a separate seamstress/tailoring trade-services registration. Second, mastectomy and post-surgical lingerie -- when sold as Medicare-billable durable medical equipment -- is regulated under federal DME supplier rules and requires the seller to be a Medicare-enrolled DME supplier. Stores selling these products without DME enrollment can carry the inventory as general retail but cannot bill Medicare.

State consumer-protection laws (General Business Law Article 22-A) apply to all retail returns and refunds; New York has no general lemon-law equivalent for clothing, but stores must clearly post their return policy.
